Prenuptial Agreement
A prenuptial agreement, or "prenup," is a contract signed by a couple before they get married. It details how their assets will be divided in the event of divorce. In England and Wales, parties will not necessarily be held to the terms of their prenuptial agreement but the agreement will be given decisive weight in the event of a divorce, depending on the circumstances of each case. This is a continually evolving area of the law and detailed legal advice should be sought. They are very much in the interests of the financially stronger party and are advisable where there is inequality of wealth in the relationship. Such agreements were almost unheard-of a decade ago in India, but are now gaining ground in Indian cities. However, Indian marriage acts do not recognize them, so courts deal with them under contract law.
